Terms of Service

By accessing or using the Smackdowness platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and Smackdowness. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

You must be at least 18 years of age (or the legal gambling age in your jurisdiction, whichever is higher) to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement.

You are responsible for ensuring that your use of the Platform complies with all laws, rules, and regulations applicable to you in your jurisdiction. Access to the Platform may not be legal for residents of certain jurisdictions. We make no representation that the Platform is appropriate or available for use in all locations.

To access certain features, you must create an account by authenticating through a supported third-party service (e.g., Kick). You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Not share your account with others
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

W-Points (Wager Points) are earned based on your wagering activity on linked partner platforms. The rate at which W-Points are earned is determined by the Platform and may change at any time without notice.

V-Points (Viewer Points) are earned through community engagement activities including but not limited to watching streams and participating in events.

Points have no monetary value and cannot be exchanged for cash. Points are non-transferable between accounts. We reserve the right to adjust, reset, or revoke points at our sole discretion in cases of abuse, fraud, or system errors.

The Platform may offer giveaways and raffles subject to their own specific rules. By entering, you agree to:

• The specific rules of each giveaway or raffle
• Accept the provably fair outcome as final
• Provide any information necessary for prize fulfillment
• Comply with all applicable tax obligations related to prizes

All draws use a provably fair cryptographic system. Results are determined by pre-committed server seeds and external entropy, making them verifiable and tamper-proof. We reserve the right to void entries or winnings obtained through fraud or violation of these Terms.

The Platform operates as an affiliate of third-party gambling platforms including but not limited to Shuffle and Luxdrop. We are not responsible for:

• The operation, fairness, or reliability of partner platforms
• Any losses incurred while gambling on partner platforms
• Changes to partner platform terms or availability
• Disputes between you and partner platforms

Use of affiliate codes is voluntary. Gambling involves risk of financial loss. Please gamble responsibly.

You agree not to:

• Use bots, scripts, or automated tools to interact with the Platform
• Create multiple accounts to exploit rewards or giveaways
• Manipulate leaderboard rankings through fraudulent activity
• Attempt to interfere with the Platform's infrastructure
• Reverse-engineer, decompile, or disassemble any part of the Platform
• Harass, abuse, or threaten other users
• Use the Platform for money laundering or other illegal activities

All content, design, code, graphics, logos, and trademarks on the Platform are the property of Smackdowness or its licensors and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit written permission.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Smackdowness shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform.

Gambling disclaimer: Smackdowness does not operate any gambling activity, does not handle real-world money in any form, and is not a casino or gambling service. We are strictly a community rewards platform that promotes third-party gambling operators through affiliate partnerships. All gambling activity occurs exclusively on external partner platforms which are independently operated and regulated. You acknowledge that gambling carries inherent financial risk and that you are solely responsible for your gambling decisions on those platforms.

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Any points, rewards, or pending prizes may be forfeited upon termination for cause.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
